We respect intellectual property rights and respond to clear, complete notices of alleged infringement.
#Our Commitment to Copyright
Upflat (https://upflat.online) publishes original indoor plant care guides, illustrations and infographics created by us. We respect the intellectual property rights of others and expect our readers to do the same.
Almost everything on this Site is our own work, so infringement claims should be rare. Where a guide quotes a published source, it does so briefly and with attribution and a link, which we believe constitutes fair dealing or fair use. If you are a copyright owner — or an agent acting for one — and you believe material on Upflat infringes your copyright, this page explains how to tell us so we can review it and, where appropriate, remove it.
We respond to notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and with equivalent procedures under other applicable law.
#How to File a Takedown Notice
If you believe your copyrighted work has been copied onto Upflat in a way that constitutes infringement, send a written notice to our designated contact below. To be effective under the DMCA, your notice must include substantially all of the following:
Your signature
A physical or electronic signature of the copyright owner, or of a person authorised to act on the owner's behalf.
Identification of the copyrighted work
A description of the work you say has been infringed. If several works are involved, a representative list is acceptable.
Identification of the material on our Site
A description of the material you say is infringing, with enough information for us to find it — ideally the exact URL of the page, and where on that page the material appears.
Your contact information
Enough for us to contact you: name, postal address, telephone number and email address.
A good-faith statement
A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
A statement of accuracy, under penalty of perjury
A statement that the information in your notice is accurate and that, under penalty of perjury, you are the copyright owner or authorised to act on the owner's behalf.
Send your notice to: Copyright contact — Upflat, hello@upflat.online. Please put "DMCA Notice" in the subject line so it is not missed.
#What We Do When We Receive a Valid Notice
On receiving a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the material identified. Where the material was submitted by someone else, we will make a good-faith effort to notify them so they can file a counter-notice. We keep a record of the notices we receive.
Because almost all content on Upflat is published by us rather than uploaded by readers, in most cases we will review the claim ourselves and remove or replace the material if there is any legitimate doubt.
#Counter-Notification
If material you submitted was removed or disabled as a result of a notice and you believe that was a mistake or misidentification, you may send us a counter-notification. To be effective under 17 U.S.C. § 512(g)(3) it must include substantially the following:
- Your signature, physical or electronic.
- Identification of the removed material and the URL at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your contact information — name, address and telephone number.
- A consent-to-jurisdiction statement: that you consent to the jurisdiction of the federal district court for the district in which your address is located, or — if your address is outside the United States — any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.
Send counter-notifications to the same address. If we receive a valid counter-notification we may restore the material no sooner than 10 and no later than 14 business days after receipt, unless we first receive notice that the original complainant has filed a court action seeking to restrain the activity.
#Repeat-Infringer Policy
In accordance with 17 U.S.C. § 512(i), we have adopted a policy of terminating, in appropriate circumstances, the access of anyone found to be a repeat infringer of copyright. We may also remove material and restrict access at our discretion, with or without notice.
#Our Own Content
The reverse case comes up more often than infringement claims against us: our guides, infographics and illustrations are regularly copied onto other sites. If you would like to use our material, see section 4 of our Terms of Service — short quotations with attribution and a link are welcome, and for anything more we are usually happy to say yes if you ask.
#Images and Photographs
All illustrations and infographics on Upflat are generated by us from our own data. We do not use stock photography libraries. If you believe an image on the Site is yours, please tell us with the URL and any evidence of ownership and we will investigate promptly.
#Trademark and Other Concerns
This policy covers copyright. For trademark, privacy, defamation or any other non-copyright concern, email hello@upflat.online describing the issue and we will respond.
#Changes to This Policy
We may update this policy from time to time. When we make material changes we will post the revised policy here and update the "Last updated" date above.
