Terms ofService
Last updated: 29 August 2026
Please read these Terms carefully before using Upflat. By accessing or using the Site, you agree to be bound by them.
#1. Acceptance of These Terms
Welcome to Upflat. These Terms of Service ("Terms") govern your access to and use of the website at https://upflat.online and any related pages, features and services (together, the "Site"), operated by Upflat ("Upflat", "we", "us" or "our"). By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site. If you are using the Site on behalf of an organisation, you confirm you are authorised to accept these Terms on its behalf.
#2. Definitions
- "Content" means all text, guides, articles, infographics, images, illustrations, data tables and other material available on the Site.
- "You" or "User" means any person who accesses or uses the Site.
- "Third-Party Services" means services operated by others, including advertising, analytics and linked websites.
#3. Eligibility
The Site is intended for a general audience. If you are a minor in your jurisdiction, you may use the Site only with the involvement of a parent or guardian. By using the Site you confirm that you can form a binding contract and are not barred from doing so under applicable law.
#4. Our Content and Intellectual Property
All guides, articles, infographics, illustrations, photographs, data tables, site design, branding and logos on Upflat are our original work, or licensed to us, and are protected by copyright and other intellectual property laws. The Upflat name and logo are our trademarks and may not be used without written permission.
Subject to these Terms, we grant you a limited, personal, non-commercial licence to access and read the Site, and to print or save individual pages for your own reference. That licence does not permit you to republish our guides, copy them into another website or application, use them to train machine-learning models for commercial purposes, or sell them.
#5. Acceptable Use
You agree not to:
- use the Site in breach of any applicable law;
- use bots, scrapers or crawlers to systematically download or copy the Site, or to overload our infrastructure;
- republish our guides, in whole or in substantial part, on another site or in another product;
- interfere with, disrupt or attempt to gain unauthorised access to the Site or its servers;
- remove or alter any copyright, trademark or attribution notices;
- use the Site to distribute malware or to engage in fraudulent, harmful or deceptive activity; or
- misrepresent our content as your own, or as endorsed by us when it is not.
#6. Plant Care Guidance Is Not Professional Advice
This is the most important section in these Terms, so it is worth reading properly.
Our guides describe general horticultural practice based on growing plants in ordinary homes and on published horticultural sources. Plants respond to conditions we cannot see from here — your light, humidity, water chemistry, temperature, pot, soil and climate all differ. Following a guide does not guarantee any particular result, and we cannot be responsible for the health of your plants.
Nothing on the Site is legal, medical, veterinary or professional advice of any kind. Where a guide mentions pesticides, fertilisers or other products, always follow the manufacturer's label and your local regulations, which take precedence over anything written here.
#7. Reader Submissions
If you send us a question, a correction, a photograph or any other material, you confirm that you own it or have the right to send it, and you grant us a non-exclusive, worldwide, royalty-free licence to use it to answer you and, where relevant, to improve or illustrate our guides. We will not publish your name or photographs without asking you first. We may decline, edit or remove any submission at our discretion.
#8. Third-Party Links
The Site links to Third-Party Services and external sources, including the horticultural and scientific references cited at the foot of each guide. We do not control and are not responsible for the content, policies or practices of any third-party site. Links do not imply endorsement, and your use of those sites is governed by their own terms.
#9. Advertising
The Site is supported by advertising, including Google AdSense. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to this Site and other websites. You may opt out of personalised advertising through Google's My Ad Center or the industry tools listed in our Privacy Policy. Where required by law we ask for your consent before advertising and other non-essential cookies are set.
We do not control the content of advertisements and are not responsible for the products or services they promote. Advertising is kept visually distinct from our editorial content, and no advertiser has any influence over what our guides recommend.
#10. Cookies and Analytics
The Site uses cookies and similar technologies for functionality, advertising and analytics, including Google Analytics and Microsoft Clarity. Full detail, and your controls, are in our Cookie Policy and Privacy Policy.
#11. Disclaimers and No Warranty
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any Content is accurate, complete or suitable for your particular conditions. See also our Disclaimer.
#12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UPFLAT AND ITS OWNERS, OPERATORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT — INCLUDING DAMAGE TO OR LOSS OF PLANTS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. Our total liability for any claim relating to the Site will not exceed one hundred pounds sterling (£100).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
#13. Indemnification
You agree to indemnify and hold harmless Upflat and its owners and operators from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your infringement of any law or third-party right.
#14. Copyright Complaints
We respect intellectual property rights. If you believe material on the Site infringes your copyright, our full notice-and-takedown procedure — including everything a valid notice must contain and how to file a counter-notice — is set out on our DMCA and Copyright Policy page. Send notices to hello@upflat.online.
#15. Governing Law and Disputes
These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the courts of the United Kingdom, and you consent to their jurisdiction — except where the law of your country of residence gives you the right to bring proceedings in your local courts, which we do not seek to remove.
#16. International Users
The Site is operated from United Kingdom. We make no representation that the Site or its Content is appropriate or available in other locations. If you access the Site from elsewhere you do so on your own initiative and are responsible for compliance with local law — including any rules on importing, growing or keeping particular plant species, which vary widely and which we do not attempt to cover.
#17. Changes to These Terms
We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page, and we will highlight material changes on the Site. Your continued use of the Site after changes are posted means you accept the revised Terms.
#18. Termination
We may suspend or withdraw access to the Site, in whole or in part, at any time and for any reason, including breach of these Terms. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnification and governing law — survive termination.
#19. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and Upflat regarding the Site.
